Understanding the H-2B Visa: Eligibility and Application Process

The H-2B visa is a non-immigrant visa program in the United States that allows U.S. employers to temporarily hire foreign workers for non-agricultural jobs when they cannot find qualified American workers. This visa is often used for industries like construction, hospitality, landscaping, and tourism. At Sintsirmas Immigration Law Co. LPA, we help immigrants and employers navigate the complexities of the H-2B visa process to meet temporary labor needs in the United States.

What is an H-2B Visa?

The H-2B visa program permits U.S. employers to hire foreign nationals for seasonal, intermittent, or peak-load needs. The visa is designed for temporary, non-agricultural roles, unlike the H-2A visa, which is designated for agricultural workers. Common industries that utilize the H-2B visa include:

  • Hospitality and Tourism
  • Construction and Landscaping
  • Forestry
  • Entertainment (such as amusement parks and fairs)

The visa is capped at 66,000 per fiscal year, split between 33,000 for each half of the fiscal year (October-March and April-September), though this cap can vary based on demand and federal adjustments.

Who Can Apply for an H-2B Visa?

Employers’ Eligibility

  • Labor Certification
: Before filing for an H-2B visa, U.S. employers must obtain a temporary labor certification from the Department of Labor (DOL), proving that no qualified U.S. workers are available for the role and that hiring foreign workers will not negatively impact wages or working conditions.
  • Temporary Need: The employer must demonstrate that the job is temporary, typically categorized under seasonal need, peak-load need, one-time occurrence, or intermittent need.

Foreign Workers’ Eligibility

  • Job Offer
: Foreign nationals need a valid job offer from a U.S. employer. This means they cannot apply independently; they must be sponsored by a qualifying employer who meets the DOL requirements.
  • Visa Eligibility Requirements: Workers must meet general visa eligibility requirements, including background checks and proof of intent to return to their home country upon the visa’s expiration.

Application Process for the H-2B Visa

  1. Labor Certification by Employer
: The employer must apply for and receive temporary labor certification from the DOL, demonstrating the necessity for foreign workers due to a shortage of available U.S. workers.
  2. File Form I-129: Once the labor certification is approved, the employer submits Form I-129 (Petition for a Nonimmigrant Worker) with U.S. Citizenship and Immigration Services (USCIS).
  3. Visa Application: Once the petition is approved, foreign workers can apply for the H-2B visa through their local U.S. Embassy or Consulate, attending an interview to finalize eligibility.
  4. Duration and Extensions: Initially granted for up to one year, the H-2B visa can be extended in increments of up to one year, with a maximum total stay of three years. After this, workers must return to their home country for at least three months before reapplying.
